Effective Transitions of Executive Power: The Role of Legal Frameworks

A smooth transfer of executive power from one administration to another is a quintessential element of democratic governance. Yet effective transitions are not guaranteed simply because election winners and losers respect the will of voters. Rather, clear principles, rules and procedures are needed to guide transition processes. Such rules support clarity, predictability and accountability across transition processes over time, and help depoliticize potentially contentious handovers. In doing so, transition frameworks are in the national interest of all democratic states.

In practice, however, while most countries’ constitutions prescribe when a transition may or must take place, only a minority of states have binding legal frameworks detailing the mechanics of transition processes. 

NDI’s new resource, Effective Transitions of Executive Power: the Role of Legal Frameworks, examines selected laws, guidelines and protocols that regulate government transitions in 16 countries around the world, representing diverse regions and political systems. It aims to support political decision-makers, civil service leaders and civil society actors to understand the role and importance of legal frameworks in advancing effective leadership transitions, and to provide examples of good practices and lessons learned in their effective operationalization.

• Detailed comparative information on the elements of transition frameworks, including:
  • Conditions under which a transfer of power may or must take place;
  • Timelines to guide activities during each phase of a transition process;
  • Rules defining the key actors and institutions involved and their responsibilities;
  • Delineated powers of and constraints operating on the various actors and institutions involved, including defined responsibilities and accountability mechanisms;
  • Rules for the allocation and management of funding, material and human resources for transition activities;
  • Mechanisms to facilitate cooperation and coordination between outgoing and incoming officials and between the incoming administration and the civil service;
  • Mechanisms for maintaining national security during the transition period; and
  • Ethics measures to guide the behavior of transition actors.

Since 2016, NDI’s Transitions of Power initiative has worked with hundreds of officials across dozens of transitions around the world to expand access to comparative global experience and improve knowledge sharing on managing transitions across different political contexts. As part of this, in 2021, NDI developed the “Global Lessons on Managing Executive Transitions” guide, which provides a comprehensive overview of transition processes in parliamentary and presidential systems and in post-conflict contexts. NDI also developed the Transitions of Power website,  which hosts guidelines, reports, tools, templates and other transition materials from around the world. This new resource on legal frameworks contributes to this growing body of knowledge and experience sharing. NDI is grateful to its partners and colleagues for their contributions and insights.
